Federal Notarial Code (Bundesnotarordnung), German Notarisation Act (Beurkundungsgesetz), the guidelines of the Chamber of Notaries, rules and regulations governing conduct of notaries, the European Code of conduct for professional responsibilities of notaries, fee scale in the Code of Conduct for European Lawyers (CCBE). Ruling out conflicts of interest
The professional rules of conduct prohibit attorneys from representing conflicting interests (Section 43a subs. 4 BRAO). The possibility of any conflicts of interests is therefore assessed before entering a client-attorney relationship.
Out-of-court arbitration
In disputes between attorneys and their clients, out-of-court arbitration with the regional chamber of lawyers is available on request (pursuant to Section 73 subs. 2 no. 3 in conjunction with Section 73 subs. 5 BRAO) or the conciliation body of the legal bar of the Bundesrechtsanwaltskammer (Section 191f BRAO).
